This Privacy Policy explains how we collect, use, share, and protect information when you visit our website at www.baylegal.com, contact us through our website forms, communicate with us via SMS/text message, or engage with us in connection with our legal services.

This policy applies to information collected through our website and digital communications. It does not govern information shared with us in the course of a confidential attorney-client relationship, which is protected separately by attorney-client privilege and applicable Rules of Professional Conduct.

What We Send and Why

BayLegal PC sends text messages (SMS) to prospective clients who have initiated contact with us by phone, web form, or text message, and to existing clients in connection with their active matters. SMS messages are used for the following purposes:

  • Responding to intake inquiries submitted via web form, phone, or text
  • Scheduling consultations and appointments
  • Providing case updates and document-status notifications
  • Responding to client questions about their matters

Our SMS phone number is (650) 668-8000 (the firm's main number), hosted via Twilio. We send SMS only to individuals who have initiated contact with us or who are existing clients — we do not send unsolicited outbound text messages to individuals who have not first contacted us.

Message and Data Rates

Message and data rates may apply. Standard messaging rates charged by your mobile carrier apply to SMS messages you send to or receive from BayLegal PC. BayLegal PC is not responsible for charges imposed by your mobile carrier.

Consent Is Not Required for Legal Services

Consent to receive SMS messages is not required as a condition of receiving legal services from BayLegal PC. You may communicate with us by phone at (650) 668-8000 or by email at info@baylegal.com at any time, regardless of whether you opt in to or out of SMS communications.

How to Opt Out (STOP) and Get Help (HELP)

You can opt out of SMS from BayLegal PC at any time by replying STOP to any message. After you reply STOP, we will send you one final confirmation message and will not send further SMS messages to that phone number unless you re-initiate contact.

Reply HELP to any message for assistance. We will respond with our contact information and instructions for reaching us by other means.

Important: Replying STOP opts out the specific phone number from SMS communications only. It does not:
- Constitute a request to delete your personal information under the CCPA/CPRA (see Section 9 for deletion requests)
- Terminate any attorney-client relationship you have with BayLegal PC
- Opt you out of communications by phone call or email

Message Frequency

Message frequency varies based on the nature of your matter and your communication preferences. Active-matter clients may receive more frequent messages during critical phases of a matter. We aim to communicate via SMS only when reasonably necessary.

7. How Long We Retain Your Information

We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with our legal obligations, and meet our professional responsibility requirements as a law firm.

We will verify your identity before processing requests for access or deletion. We will respond within 45 calendar days. If more time is needed, we will notify you within the initial 45-day period. We may respond to up to 2 requests per 12-month period free of charge.

Reminder: Replying STOP to an SMS from BayLegal PC opts out of SMS only. It is not a CCPA deletion request. To submit a formal deletion request, use the contact information above.


10. Do Not Sell or Share

BayLegal PC does not sell personal information to third parties. BayLegal PC does not share personal information for cross-context behavioral advertising as defined under Cal. Civ. Code §1798.140.


11. Children's Privacy

Our website and services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from children under 18. If you believe we have inadvertently collected information from a minor, please contact us at Amy@baylegal.com and we will take steps to delete it.


12. Security

We implement reasonable technical, administrative, and physical safeguards to protect personal information from unauthorized access, disclosure, alteration, or destruction. These include access controls, encrypted transmission of data where appropriate, and vendor security assessments.

No data transmission over the internet or storage system is 100% secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately at Amy@baylegal.com.

In the event of a data breach affecting your personal information, we will notify affected individuals as required by California Civil Code §1798.82.
